New York, NY – Paul Hastings LLP, a leading global law firm, announced today that IP Partners Yar Chaikovsky, Blair Jacobs and Chris Kennerly have been named to the third annual list of Litigation Trailblazers published by The National Law Journal. Litigation Trailblazers profiles 50 litigators who are models of legal innovation and strategic thinking.
Chaikovsky was also named one of The National Law Journal’s Winning Litigators, which profiles battle-tested litigators who have secured high-stakes, significant victories in cases ranging from product liability to patent law.
Litigation Trailblazers
In Litigation Trailblazers, The National Law Journal recognizes Chaikovsky, Jacobs, and Kennerly for a precedential win on behalf of AT&T, which was severed and stayed from litigation initiated by Cellular Communications Equipment against Apple and cellular network providers regarding patents for LTE technology. The Paul Hastings team crafted a strategy to limit the case to infringement claims against the accused devices, resulting in a rare sever and stay for AT&T and other network carriers, all of whom were removed from a jury trial in the Eastern District of Texas shortly before the commencement of a trial that resulted in a verdict against Apple. The team convinced the Court to reconsider an earlier ruling not to sever AT&T and other carriers from the case, thus eliminating risk on the eve of trial.
Winning Litigators
One of 20 “Winning Litigators,” Chaikovsky, global co-chair of the firm’s intellectual practice, was recognized for a victory on behalf of Trend Micro, which resolved six years of high-stakes litigation against Intellectual Ventures (IV) with $150 million in damages on the line. While others had settled with IV, Chaikovsky argued that the U.S. Supreme Court’s Alice decision rendered IV’s claims on a method of filtering email were patent ineligible. The U.S. Court of Appeals for the Federal Circuit affirmed a summary judgment win against IV on patent ineligibility grounds, winning a complete victory for Trend Micro without the cost of a trial.
These recognitions from The National Law Journal follow a steady stream of awards for the Intellectual Property practice. Most recently, the Financial Times commended Gerald Flattmann in its North America Innovative Lawyers 2016 report in the “Innovation in unlocking and delivering value” category for defeating two landmark IPR challenges on behalf of Acorda Therapeutics, Inc.
